2. Prohibited Activities and Behaviors
You are expressly prohibited from:
- Using our services for any unlawful purpose or to solicit unlawful activity
- Harassing, threatening, or intimidating other users or Aptivex staff
- Submitting false, misleading, or fraudulent information
- Attempting to circumvent assessment protocols or manipulate evaluation results
- Sharing, copying, or distributing proprietary assessment materials without authorization
- Interfering with the proper functioning of our services or security measures
- Impersonating another person or entity
- Collecting or harvesting user information without consent
3. Content Guidelines and Restrictions
When submitting content or information through our services, you must ensure that your submissions:
- Do not violate any third-party rights, including intellectual property and privacy rights
- Do not contain defamatory, obscene, or offensive material
- Do not include malicious code, viruses, or harmful software

- Your negligent or willful misconduct
3. Privacy and Data Protection
You acknowledge that you have reviewed and understood our Privacy Policy. You are responsible for maintaining the confidentiality of your personal information and assessment results. You agree not to share sensitive information through unsecured channels and to notify us immediately of any suspected unauthorized access to your information.
4. Third-Party Interactions
Your interactions with third parties, including certification bodies, educational institutions, or employers, based on assessment results obtained through our services are solely between you and such third parties. Aptivex is not responsible for any disputes, losses, or damages arising from these interactions.
Disclaimers and Limitations of Liability
1. Disclaimer of Warranties
Aptivex provides its services on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding:
- The accuracy, completeness, or reliability of assessment results
- The suitability of our services for any specific purpose
- The availability, quality, or performance of our services
- The security of our systems or protection against unauthorized access
- The results, outcomes, or benefits that may be achieved through our services
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
2. Limitation of Liability
To the maximum extent permitted by applicable law, Aptivex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Loss of data or information
- Career setbacks or employment-related losses
- Emotional distress or reputational harm
- Costs of procurement of substitute services
Our total liability for any claims arising from or related to our services shall not exceed the amount you have paid to Aptivex for the specific service giving rise to the claim, or ₹10,000, whichever is less.
3. Consequential Damages Exclusion
We are not responsible for any consequences that may arise from your use of assessment results, including decisions made by you or third parties based on evaluation reports. Assessment results reflect performance at a specific point in time and should be considered as one of many factors in professional development decisions.
4. Force Majeure Provisions
Aptivex shall not be liable for any failure or delay in performance of our obligations due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, internet or telecommunications failures, or other force majeure events.
Legal Framework and Dispute Resolution
1. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
2. Dispute Resolution Procedures
In the event of any dispute, controversy, or claim arising out of or relating to these terms or our services, the parties agree to first attempt resolution through good faith negotiations. If the dispute cannot be resolved through direct negotiation within 30 days, the parties may pursue:

6. Waiver and Assignment
No waiver of any provision of these terms shall be deemed a further or continuing waiver of such provision or any other provision. Aptivex's failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision. You may not assign or transfer these terms or your rights hereunder without our prior written consent. Aptivex may assign these terms without restriction.

Assessment services provided by Aptivex are intended for professional development and competency evaluation purposes only. Results should not be considered as:
- Guarantees of employment, certification success, or career advancement
- Definitive measures of absolute capability or potential
- Substitutes for official certification examinations or licensing requirements
- Medical, psychological, or clinical diagnoses of any kind
We recommend consulting with qualified career advisors, educational counselors, or industry professionals when making significant decisions based on assessment results. Aptivex is not affiliated with official certification bodies unless explicitly stated.
